Algemene Voorwaarden

Algemeen
1.) Bedrijfsomschrijving
The Female Way Academy richt zich op producten, training, coaching en workshops binnen het werkveld van persoonlijke ontwikkeling, in de meest ruime zin. The Female Way Academy is bij de Kamer van Koophandel ingeschreven onder nummer: 52310922, Vestigingsnr. 000022253971 en adres Javakade 486, 1019SC, Amsterdam.
2.) Toepasselijkheid
Deze algemene voorwaarden zijn van toepassing op alle mondelinge en schriftelijke offertes en overeenkomsten van of met en alle daarmee verband houdende handelingen, zowel van voorbereidende als uitvoerende aard. Op deze Algemene voorwaarden is het Nederlands recht van toepassing. Geschillen zullen worden voorgedragen aan de (kanton)rechter te Amsterdam indien het geschil niet in der minne kan worden geschikt.
3.) Intellectuele eigendom
Opdrachtnemer is rechthebbende op de intellectuele eigendomsrechten met betrekking tot de door hem – in het kader van de Opdracht – aan The Female Way Academy en/of Cliënt verstrekte of – in het kader van deze Opdracht – gebruikte producten, waaronder begrepen maar niet beperkt tot testen, readers, rapporten, modellen, beeldmateriaal, oefenmateriaal, trainingsmateriaal en computerprogramma’s.
Opdrachtgever mag niet zonder uitdrukkelijke schriftelijke toestemming van Opdrachtnemer geen gebruik maken van deze producten, waarop Opdrachtnemer rechthebbende is ten aanzien van de intellectuele eigendomsrechten, anders dan ten behoeve van deze Opdracht.
Opdrachtnemer is gerechtigd om de door de uitvoering van de werkzaamheden verkregen kennis voor andere doeleinden te gebruiken, voor zover hierbij geen vertrouwelijke informatie ter kennis van derden wordt gebracht en mits niet te herleiden tot individuele The Female Way Academy c.q. cliënten.
Ook de door de The Female Academy gemaakte Podcasts genieten bescherming onder de Auteurswet. De podcasts zijn op grond van deze wet eigendom van The Female Way Academy. Zonder toestemming kunnen de podcasts niet door derde openbaar worden gemaakt of verveelvoudigd worden.
4.) Klachtenprocedure
Klachtenprocedure
Indien u een klacht heeft of ontevreden bent over de dienstverlening, verneem ik dit graag van u teneinde de oorzaak van de klacht of ontevredenheid zo snel mogelijk te kunnen wegnemen.
Officiële klacht
Wanneer u een klacht indient zou ik u willen verzoeken de klacht officieel te melden per e-mail dan wel per brief. Binnen 5 werkdagen na het ontvangst, zal ik schriftelijk contact met u opnemen om te kijken hoe we de klacht kunnen oplossen.

Verwerking van de klacht
Het streven is om de klacht binnen vier weken na ontvangst op te lossen. Indien er onverhooptmeer tijd nodig is dan zal ik u hier uiteraard over informeren. De klacht zal vertrouwelijk worden behandeld. Nadat de klacht is afgehandeld, bewaar ik de correspondentie rondom de klacht maximaal 365 dagen.
Niet eens met de beslissing?
Indien u zich niet kan verenigen met de voorgestelde oplossing en de daaruit voortvloeiende beslissing dan kunt u dit schriftelijk aangeven. De klacht zal dan worden doorgestuurd naar een onafhankelijke derde: Mw. mr D. Verlinden. Zij reageert binnen 4 weken op de klacht. Ik confirmeer me aan haar oordeel
5.) Aansprakelijkheid
The Female Way Academy aanvaardt geen enkele aansprakelijkheid, hoe dan ook, voor schade / overbelasting ontstaan door of in verband met door haar verrichte diensten.
De aansprakelijkheid van The Female Way Academy is beperkt tot de factuurwaarde van de opdracht voor de te leveren dienst of product, voor zover er sprake is t.
In afwijking van hetgeen in lid 2 van dit artikel is bepaald, wordt bij een opdracht met een langere looptijd dan zes maanden, de aansprakelijkheid verder beperkt tot het over de laatste zes maanden verschuldigde factuurbedrag.
Opdrachtnemer is niet aansprakelijk voor directe of indirecte schade die The Female Way Academy lijdt ten gevolge van handelingen of beslissingen genomen naar aanleiding van of tijdens een training, coaching sessie of adviesopdracht. The Female Way Academy blijft ten alle tijden zelf verantwoordelijk voor gemaakte keuzes, beslissingen en acties.
Elke aansprakelijkheid van opdrachtnemer voor bedrijfsschade of andere indirecte schade of gevolgschade, van welke aard dan ook, is nadrukkelijk uitgesloten.
De onder dit artikel opgenomen bepalingen gelden ook ten aanzien van het door The Female Way Academy uitbesteedde opdrachten aan collega coaches die niet werkzaam zijn voor The Female Way Academy.
Coaching
1.) Definities
Opdrachtnemer is in deze The Female Way Academy geregistreerd bij het Collectief Alternatieve Therapeuten (CAT reglement), en gebruikt deze algemene voorwaarden bij het aanbieden van haar diensten. De opdrachtgever is in deze de klant die gebruik maakt van de aangeboden diensten van The Female Way Academy. Als overeenkomst wordt gezien alle afspraken die gemaakt worden tussen opdrachtgever en opdrachtnemer over de aan te bieden diensten. Deze afspraken worden schriftelijk bevestigd opdrachtgever in het voorstel, intakegesprek en factuur.
2.) Uitvoering van de overeenkomst
Opdrachtnemer zal de overeenkomst naar beste inzicht en vermogen uitvoeren. Opdrachtnemer heeft jegens de uitvoering van de overeenkomst een inspanningsverplichting en kan derhalve niet worden aangesproken vanuit een resultaatsverplichting.
Door bevestiging van de overeenkomst en deze algemene voorwaarden geeft de opdrachtgever de The Female Way Academy toestemming haar NAW gegevens plus telefoonnummer te gebruiken voor vastlegging in het klantenbestand van opdrachtnemer voor administratiedoeleinden.
De opdrachtgever draagt er zorg voor dat alle informatie, waarvan The Female Way Academy aangeeft dat deze noodzakelijk zijn of waarvan de opdrachtgever redelijkerwijs behoort te begrijpen dat deze nodig zijn voor het uitvoeren van de overeenkomst, tijdig aan opdrachtnemer worden verstrekt. Indien deze gegevens niet tijdig zijn verstrekt behoudt opdrachtnemer zich het recht voor de uitvoering van de overeenkomst op te schorten.
3.) CAT reglement
Opdrachtgever is op de hoogte van de door opdrachtnemer gebruikte behandelvorm(en) en THE FEMALE WAY ACADEMY FEMALE LIFESTYLE COACHING van het behandelplan (rekening houdende met het feit dat een behandelplan een schatting is en te allen tijde aanpasbaar.). Deze zal na intake formulier en intake gesprek worden vastgesteld.
Opdrachtnemer mag de opdrachtgeverdoor verwijzen naar een collega indien het coachtraject niet toereikend is of niet kan worden voortgezet wegens ziekte, overlijden of een aandoening. 3. Indien het coachtraject wordt beëindigd door de opdrachtgever en dit gebeurt tegen het advies van de CAT-therapeut in; de opdrachtgever dit doet voor eigen risico en bereid is een verklaring te tekenen waarop The Female Way Academy erkent het coachtraject zonder goedkeuring van de CAT-therapeut te beëindigen.
Het coachtraject door de CAT-therapeut eenzijdig kan worden beëindigd als redelijkerwijs niet van hem/haar kan worden verwacht dat hij/zij de behandeling voortzet.
De opdrachtgeverop de hoogte is van het feit dat de CAT-therapeut een klantendossier bijhoudt.
De CAT-therapeut dit klantendossier behandelt overeenkomstig met de Nederlandse privacy regeling en overeenkomstig met de eisen die gesteld worden door het CAT-bestuur.
De opdrachtgever een kopie kan vragen van dit klantendossier dat op The Female Way Academy van betrekking is.
De opdrachtgeververnietiging van het klantendossier dat op The Female Way Academy van toepassing is kan eisen en de CAT-therapeut wettelijk verplicht is hier aan mee te werken tenzij er een wettelijk (juridische) aanwijsbare reden voor is of indien de persoonsgegevens essentieel zijn voor de zorg van een andere The Female Way Academy in verband met erfelijke ziektes of vanwege een andere aanwijsbare medische oorzaak.
4.) Prijzen en offertes
Alle offertes en prijsopgaven door opdrachtnemer gedaan, zijn vrijblijvend, zowel wat betreft prijs, inhoud en levertijd en vervallen na 30 dagen.
Offertes zijn gebaseerd op de bij opdrachtnemer beschikbare informatie.
De opdrachtgever is op de hoogte gesteld van de door opdrachtnemer gevraagde tarieven.
Een overeenkomst komt tot stand op het moment dat de door The Female Way Academy de fee voor 6 maanden in totaal is voldaan en de voor akkoord getekende offerte of overeenkomst door opdrachtnemer getekend wordt teruggestuurd per mail.
In de overeenkomst kunnen nadere prijsafspraken worden vastgelegd, zoals inhuur derden, inhuur accommodatie, deelname partners, middelen, reiskosten e.d.
Tailor made prijzen voor de opdrachtgever geven geen garantie voor de nieuwe prijs bij verlenging. 6. De opdrachtnemer is gerechtigd ieder jaar de overeengekomen prijs te verhogen.
Neem contact op met ons indien je in termijnen wenst te betalen.
5.) Betalingsvoorwaarden
Facturatie vindt plaats zoals aangegeven in de bijgevoegde voorstel. Betaling vindt plaats in onderling overleg over tussen The Female Way Academy en opdrachtnemer. The Female Way Academy ontvangt een factuur van opdrachtnemer en de betaling dient te geschieden door overmaking van IBAN NL 91 ABNA 0453 8984 91 t.n.v. The Female Way Academy.
Bij niet tijdige betaling of het verzuimen van de betaling is The Female Way Academy van rechtswege in verzuim en behoudt opdrachtnemer zich het recht voor de uitvoering van de overeenkomst met onmiddellijke ingang stop te zetten. Ook is The Female Way Academy vanaf dat moment wettelijke rente verschuldigd over het openstaande bedrag. Indien opdrachtnemer de vordering ter incasso uit handen geeft is The Female Way Academy tevens verschuldigd de gerechtelijk en buitengerechtelijke kosten die met deze incasso gemoeid zijn.
Bij eventuele bezwaren aangaande de factuur dient The Female Way Academy dit binnen 24 uur na het ontvangen van de factuur schriftelijk kenbaar te maken bij opdrachtnemer.
6.) Duur en beëindiging
De duur van het coachtraject zoals vastgelegd in de overeenkomst tussen The Female Way Academy en opdrachtnemer, kan ten alle tijden met wederzijds goedvinden na de 6 maanden, door beide partijen worden verlengd dan wel beëindigd.
Beëindiging van het coachtraject kan eenzijdig plaatsvinden na de 6 maanden, door de opdrachtgeverindien hij/zij de behandeling niet langer op prijs stelt of nodig acht.
Beëindiging van de overeenkomst laat onverlet de financiële verplichting die nog nagekomen moeten worden en reeds voldaan zijn.
Beëindiging van de overeenkomst door de opdrachtgever binnen de commitment van 6 maanden laat onverlet de financiële verplichting die reeds is voldaan. De resterende tijd kan worden ingezet bij een van de vele mooie hoedanigheden van de The Female Way Academy. Termijn kan nader worden vastgesteld. Er kan zelfs nog gekeken worden naar het doneren aan derden van de resterende tijd, met goedkeuring Opdrachtnemer.
Indien wordt verzocht om vroegtijdige beëindiging van de overeenkomst, bijvoorbeeld doordat de coaching niet langer nodig wordt geacht of er een aan de coaching gerelateerd inhoudelijk verschil van inzicht is, is restitutie van het reeds betaalde geld niet mogelijk.
7.) Aanmelding en betaling voor trainingen en workshops met open inschrijving
Bij aanmelding voor trainingen en workshops met open inschrijving gelden de volgende betalingsvoorwaarden:
Bij aanvang van de training en/of workshops dient de betaling op rekening van opdrachtnemer te zijn bijgeschreven.
Bij populaire training en/of workshop kan het zijn dat de betaling reeds ver van te voren binnen moet zijn om zeker te zijn van een plaats.
Annulering door The Female Way Academy voor training en workshops met open inschrijving. The Female Way Academy verplicht zich een eventuele annulering of wijziging schriftelijk door te geven aan opdrachtnemer. Bij annulering van inschrijving door The Female Way Academy treden The Female Way Academy en opdrachtnemer eerst in overleg om te komen tot passende alternatieven. Indien er geen passende alternatieven mogelijk zijn, zulks ter beoordeling van opdrachtnemer, gelden annuleringsvoorwaarden. The Female Way Academy is verplicht annuleringskosten te betalen aan opdrachtnemer, als volgt:
Bij annulering na inschrijving tot 8 weken voor aanvang zijn de annuleringskosten 25%.
Bij annulering na inschrijving tot één week voor aanvang zijn de annuleringskosten 50%.
Bij annulering na inschrijving binnen één week voor aanvang zijn de annuleringskosten 100%. Dit geldt ook voor tussentijdse beëindiging, bij aanvang, of bij het niet verschijnen bij de training of workshop.
Annulering door opdrachtnemer. Opdrachtnemer behoudt zich het recht om coaching, training of workshops te annuleren, zonder opgaaf van redenen, dan wel een cliënt te weigeren. Opdrachtnemer verplicht zich de annulering c.q. weigering schriftelijk te bevestigen en betaalt in dat geval 100% van het tot dan toe door The Female Way Academy betaalde bedrag terug, waarmee de overeenkomst is beëindigd zonder verder verplichtingen of aanspraken over en weer.
8.) Het verzetten van afspraken
Indien de opdrachtgever de door haar/hem gemaakt afspraak binnen 24 uur voor de desbetreffende afspraak annuleert zal opdrachtnemer de kosten in rekening brengen en is opdrachtgever verplicht deze te betalen. Afspraken die geannuleerd of verzet worden voor deze tijd zullen niet in rekening worden gebracht.
Bij niet verschijnen van de opdrachtgever op een gepland gesprek worden de kosten voor het gesprek in rekening gebracht en is opdrachtgever verplicht deze te betalen. Indien de betaling al vooraf heeft plaatsgevonden, dan hebben we het hier over een afspraak die niet meer ingehaald kan worden.
Opdrachtnemer behoudt zich het recht voor afspraken te verzetten of te annuleren indien zij niet naar behoren uitvoering kan geven aan de overeenkomst.
9.) Geheimhouding
Beide partijen zijn verplicht tot geheimhouding van alles wat is besproken tijdens of in het kader van de coaching sessies, trainingen of adviesopdrachten. Hiertoe zal ook voorafgaand aan de sessie aan iedere deelnemer worden gevraagd een geheimhoudingsverklaring te ondertekenen.
In het geval van dreigend gevaar voor zowel The Female Way Academy als de samenleving behoudt opdrachtnemer zich het recht de geheimhouding te doorbreken en zal zij de daartoe bevoegde en bestemde instanties inlichten.
Indien op grond van een wettelijke bepaling of een rechterlijke uitspraak opdrachtnemer gehouden is vertrouwelijke informatie aan door de wet of de bevoegde rechter aangewezen derden mede te verstrekken en opdrachtnemer zich ter zake niet kan beroepen op een wettelijk dan wel door de bevoegde rechter erkend of toegestaan recht van verschoning, dan is opdrachtnemer niet gehouden tot schadevergoeding of schadeloosstelling.
10.) Workshop & evenementen
Alle geboekte workshopdata zijn definitief. Restituties of omruilingen worden onder geen enkele omstandigheid toegestaan. Dit beleid is ingesteld vanwege het voorbereidende werk en de logistiek die komt kijken bij de organisatie van de workshopsessies, maar ook om eerlijkheid en integriteit in systeem en werk te garanderen.
Maak je boekingen zorgvuldig en wees zeker van je beschikbaarheid op de geselecteerde data voordat je je boeking bevestigt. Het is eigen verantwoordelijkheid om ervoor te zorgen dat de gekozen data geschikt zijn voor jouw agenda en om ze te onthouden, en daadwerkelijk te verschijnen op de dag zelf.
Producten: betaling, verzending en retour
1.) Betaling
Overschrijving
U kunt ervoor kiezen om het geld persoonlijk over te maken op onze rekening. Het kan enkele dagen duren voordat de overdracht is voltooid. Nadat we het geld hebben ontvangen, verzenden we je bestelling. Het rekeningnummer is NL 91 ABNA 0453 8984 91. De BIC / Swift-code is ABNANL2A. Wij vragen u vriendelijk uw naam en ordernummer te vermelden bij de overschrijving en ons ook een e-mail te sturen ([email protected]).
PayPal
PayPal is een wereldwijde online betaaldienst, die zowel de klant als de webshop uitstekende service en veiligheid biedt voor online betalingen. Als u geen PayPal-account heeft, kunt u er ook voor kiezen om er een aan te maken, maar dit is niet nodig voor een creditcardbetaling. PayPal is internationaal, werkt met e-mailadres en wachtwoord, is snel en gemakkelijk te onthouden en supergemakkelijk en snel te gebruiken
Ideal
Het is eveneens mogelijk om te betalen via Ideal. U kunt gebruik maken van Ideal indien u een betaalrekening heeft waarmee u kan internet bankieren.
2.) Verzending
Verzending
Nadat wij uw bestelling en betaling hebben ontvangen, verzenden wij uw bestelling. De levering duurt normaal gesproken 3 – 5 werkdagen. Als uw bestelling op voorraad is, kan het 48 uur duren voordat de levering op uw adres aankomt. Om je pakket thuis te kunnen bezorgen, maken wij het pakket met je naam erop over naar Post NL. Het verzenden van een normaal pakket binnen Nederland kost € 4,95.
Niet thuis?
Ben je niet thuis op het moment dat de bezorging plaatsvindt, dan laat de bezorger van Post NL een bericht achter met daarin een ‘niet-thuis-code’. Met deze code kunt u een afspraak maken voor een tweede afleverpoging. Hiervoor moet u eerst inloggen. U kunt kiezen voor een tweede levering op een andere dag. Maak je geen afspraak voor een tweede bezorging, dan vindt de bezorging automatisch de volgende dag plaats.
Internationale verzending
Wij doen ook internationale zendingen. De verzendkosten binnen Europa bedragen € 7,50 afhankelijk van de grootte van het pakket. Verzendkosten buiten Europa verschillen per land. Wilt u uw pakket naar een ander land verzenden? Stuur ons dan een e-mail ([email protected]), meestal kunnen we de bezorging voor je regelen.
3.) Retour
Registreer retouren of ruilingen van tevoren
Wil je een product ruilen of retourneren? Wij verzoeken u vriendelijk om dat bij ons te melden door een e-mail te sturen naar [email protected] op deze wijze kunnen wij ervoor zorgen dat u uw geld zo snel mogelijk terugkrijgt nadat het item door ons is ontvangen.
Vereisten voor retourneren of ruilen
Ben je niet tevreden over de maat, kleur of enig ander aspect van het bestelde artikel? Dan kun je het artikel binnen 14 dagen retourneren. We gaan ervan uit dat het artikel niet gebruikt, gedragen of beschadigd is en voorzien is van het originele label. Alle items die naar ons worden geretourneerd, moeten in originele staat aankomen, in hun originele verpakking, zonder prijsstickers, gaten of andere wijzigingen, anders wordt de retourzending geweigerd. Indien aan deze voorwaarden is voldaan, storten wij het aankoopbedrag binnen 30 dagen terug op uw rekening.
Verzendkosten retour
De verzendkosten van het te retourneren artikel zijn voor eigen rekening.

1.) Company Description
The Female Way Academy focuses on products, training, coaching and workshops within the field of personal development, in the broadest sense. The Female Way Academy is registered with the Chamber of Commerce under number: 52310922, establishment number 000022253971 and address Javakade 486, 1019SC, Amsterdam.
2,)Applicability
These General Terms and Conditions apply to all verbal and written offers and agreements of or with and all related actions, both of a preparatory and executive nature. These General Terms and Conditions are governed by Dutch law. Disputes will be submitted to the (cantonal) court in Amsterdam if the dispute cannot be settled amicably.
3.) Intellectual property
The Contractor is entitled to the intellectual property rights relating to the products supplied by him – as part of the Assignment – to The Female Way Academy and/or the Client or used by him – as part of this Assignment – including but not limited to tests, readers, reports, models, visual materials, practice materials, training materials and computer programs.
Without Octrooibureau Novopatent’s express written permission, Client may not use such products, to which Octrooibureau Novopatent is entitled with regard to intellectual property rights, other than for the purpose of this Assignment.
Octrooibureau Novopatent is entitled to use the knowledge acquired in executing the work for other purposes, to the extent that no confidential information is brought to the attention of third parties and provided that it cannot be traced back to individual The Female Way Academy or clients.
The Podcasts produced by The Female Academy are also protected under the Copyright Act. On the basis of this law, the podcasts are the property of The Female Way Academy. Without permission, the podcasts cannot be made public or reproduced by third parties.
4.) Complaint procedure
Complaint procedure
If you have a complaint or are dissatisfied with the service, I would like to hear from you so that the cause of the complaint or dissatisfaction can be eliminated as quickly as possible.
Official complaint
When you file a complaint I would like to ask you to officially report the complaint by e-mail or by letter. Within 5 working days of receipt, I will contact you in writing to see how we can resolve the complaint.

Processing the complaint
The aim is to resolve the complaint within four weeks after receipt. If unexpectedly more time is needed, I will of course inform you of this. The complaint will be handled confidentially. After the complaint has been dealt with, I will keep the correspondence relating to the complaint for a maximum of 365 days.
Disagree with the decision?
If you do not agree with the proposed solution and the resulting decision you can indicate this in writing. The complaint will then be forwarded to an independent third party: Mrs. D. Verlinden. She will respond to the complaint within 4 weeks. I confirm myself to her judgment
5.) Liability
The Female Way Academy accepts no liability whatsoever for damage/overload caused by or in connection with the services she provides.
The liability of The Female Way Academy is limited to the invoice value of the order for the service or product to be delivered, insofar as there is.
Notwithstanding the provisions of paragraph 2 of this article, in the case of an assignment with a duration of more than six months, the liability shall further be limited to the invoice amount owed for the last six months.
The contractor is not liable for direct or indirect damage suffered by The Female Way Academy as a result of actions or decisions taken on or during a training course, coaching session or consultancy assignment. The Female Way Academy remains at all times personally responsible for made choices, decisions and actions.
Any liability of the contractor for loss of business or other indirect or consequential loss of any kind is expressly excluded.
The provisions contained in this article also apply to assignments outsourced by The Female Way Academy to fellow coaches who do not work for The Female Way Academy.
1.) Definitions
Contractor in this The Female Way Academy is registered with the Collective Alternative Therapists (CAT regulations), and uses these general terms and conditions in offering its services. The client is in this case the customer who uses the services offered by The Female Way Academy. As an agreement is considered all agreements made between client and contractor about the services to be offered. These agreements will be confirmed in writing client in the proposal, intake interview and invoice.
2.) Execution of the agreement
Octrooibureau Novopatent shall execute the agreement to the best of its knowledge and ability. Contractor has a best effort obligation towards the execution of the agreement and can therefore not be addressed from a result obligation.
By confirming the agreement and these general terms, the client gives The Female Way Academy permission to use her name and address plus telephone number for registration in the contractor’s customer file for administration purposes.
The client shall ensure that all information which The Female Way Academy indicates to be necessary or which the client should reasonably understand to be necessary for the execution of the contract shall be supplied in good time to the contractor. If this information is not provided in time, the contractor reserves the right to suspend the execution of the agreement.
3.) CAT regulations
The client is aware of the treatment form(s) used by the contractor and THE FEMALE WAY ACADEMY FEMALE LIFESTYLE COACHING of the treatment plan (taking into account that a treatment plan is an estimate and can be adjusted at any time). This will be determined after intake form and intake interview.
The Contractor may refer the client to a colleague if the coaching program is inadequate or cannot be continued due to illness, death or a condition. 3. If the coaching program is terminated by the client and this is done against the advice of the CAT therapist; the client does this at their own risk and is prepared to sign a statement in which The Female Way Academy acknowledges terminating the coaching program without the approval of the CAT therapist.
The coaching program can be terminated unilaterally by the CAT therapist if he/she cannot reasonably be expected to continue the treatment.
The client is aware of the fact that the CAT therapist keeps a client file.
The CAT-therapist handles this client file in accordance with the Dutch privacy regulation and in accordance with the requirements set by the CAT board.
The client may request a copy of this client file pertaining to The Female Way Academy.
The client may demand destruction of the client file applicable to The Female Way Academy and the CAT Therapist is legally obliged to cooperate in this unless there is a legally (legally) identifiable reason for this or if the personal data is essential for the care of another The Female Way Academy in connection with hereditary diseases or because of another identifiable medical cause.
4.) Prices and quotations
All offers and quotations made by the contractor are without obligation, both in terms of price, content and delivery time and expire after 30 days.
Quotations are based on the information available to the contractor.
The client has been informed of the rates charged by the contractor.
An agreement comes into being when the fee for 6 months in total has been paid by The Female Way Academy and the offer or agreement signed for approval is returned by the contractor by mail.
In the agreement further price agreements can be made, such as hiring third parties, hiring accommodation, participation of partners, resources, travel expenses, etc.
Tailor made prices for the client do not guarantee the new price at renewal. 6. The contractor is entitled to increase the agreed price every year.

5.) Payment Terms
Invoicing will take place as indicated in the attached proposal. Payment will take place in mutual consultation between The Female Way Academy and the contractor. The Female Way Academy will receive an invoice from the contractor and payment should be made by bank transfer to IBAN NL 91 ABNA 0453 8984 91 in the name of The Female Way Academy.
If payment is not made on time or if the payment is neglected, The Female Way Academy will be in default by operation of law and the contractor reserves the right to halt the execution of the contract with immediate effect. The Female Way Academy shall also owe statutory interest on the outstanding amount from that time. If the contractor hands over the claim for collection, The Female Way Academy will also owe the judicial and extrajudicial costs involved in this collection.
In case of any objections concerning the invoice, The Female Way Academy must make this known to the contractor in writing within 24 hours of receiving the invoice.
6.) Duration and termination
The duration of the coaching trajectory as laid down in the contract between The Female Way Academy and the contractor can be extended or terminated by both parties at all times by mutual agreement after the 6 months.
Termination of the coaching trajectory can take place unilaterally after 6 months, by the client if he/she no longer appreciates the treatment or considers it necessary.
Termination of the agreement does not affect the financial obligations that still need to be fulfilled and have already been paid.
Termination of the agreement by the client within the commitment of 6 months does not affect the financial obligation already fulfilled. The remaining time can be used in one of the many wonderful capacities of The Female Way Academy. Term can be further determined. Donating to third parties of the remaining time may even be considered, with Contractor’s approval.
If early termination of the agreement is requested, for example because the coaching is no longer considered necessary or there is a difference of opinion about the content related to the coaching, a refund of the money already paid is not possible.
7.) Registration and payment for training and workshops with open registration
When registering for training and workshops with open registration the following payment conditions apply:
At the start of the training and / or workshop the payment must be credited to the account of the contractor.
In case of a popular training and/or workshop, it is possible that the payment must be received far in advance in order to be sure of a place.
Cancellation by The Female Way Academy for training and workshops with open enrolment. The Female Way Academy commits itself to inform the customer in writing of any cancellation or change. In case of cancellation of registration by The Female Way Academy, The Female Way Academy and the contractor will first consult to find suitable alternatives. If no suitable alternatives are possible, at the discretion of the contractor, cancellation conditions will apply.
The Female Way Academy is required to pay cancellation fees to the Contractor as follows:
For cancellation after registration up to 8 weeks before the start, the cancellation fee is 25%.
For cancellation after enrollment up to one week before commencement, the cancellation fee is 50%.
For cancellation after registration within one week before the start, the cancellation fee is 100%. This also applies to early termination, at the start, or not appearing at the training or workshop.
Cancellation by Contractor. The contractor reserves the right to cancel coaching, training or workshops, without giving reasons, or to refuse a client. The contractor undertakes to confirm the cancellation or refusal in writing and will in that case refund 100% of the amount paid so far by The Female Way Academy, which will end the agreement without further obligations or claims from either side.
8.) Rescheduling of appointments
If the client cancels the appointment made by her/him within 24 hours before the appointment in question, the contractor will charge the costs and the client is obliged to pay them. Appointments cancelled or rescheduled before this time will not be charged.
If the client fails to appear at a scheduled meeting, the costs of the meeting will be charged and the client will be obliged to pay these. If payment has already been made in advance, we are talking about an appointment that can no longer be made up.
Contractor reserves the right to reschedule or cancel appointments if she is unable to properly execute the agreement.
9.) Confidentiality
Both parties are bound to secrecy of everything discussed during or in the context of the coaching sessions, training or consultancy assignments. To this end, each participant will be asked to sign a confidentiality agreement prior to the session.
In case of imminent danger for both The Female Way Academy and society, the contractor reserves the right to break the secrecy and will inform the competent and appropriate authorities.
If a statutory provision or a judicial decision obliges the contractor to disclose confidential information to third parties designated by law or by the competent court and the contractor is unable to invoke a legal right to refuse to give evidence or such a right acknowledged or allowed by the competent court, the contractor will not be held to pay damages or compensation.
10.) Workshop & Events
All workshop dates once booked are final. No refunds or exchanges will be permitted under any circumstances. This policy is in place due to the preparatory work and logistics involved in the organization of the workshop sessions, as well as to ensure fairness and integrity in system and work.
Please make your bookings carefully and be sure of your availability on the selected dates before confirming your booking. It is your responsibility to ensure that the dates chosen are suitable for your schedule, and to remember them, showing up is own responsibility.
